Introduction
These Terms and Conditions constitute a legally binding agreement between Travel Holidays Tours & Safari Ltd (“the Company”, “we”, “our”, or “us”) and the person(s) making a booking (“the Client”, “guest”, “traveler”, or “you”).
By confirming a booking, making a payment, or participating in any tour, safari, trekking expedition, beach holiday, or travel service arranged by Travel Holidays Tours & Safari Ltd, you acknowledge that you have read, understood, and accepted these Terms and Conditions.
1. Booking & Reservation
1.1 Deposit Requirement
A non-refundable deposit of 30% of the total tour cost is required to secure your booking.
1.2 Booking Confirmation
A reservation is considered confirmed only after the required deposit has been received and a formal booking confirmation has been issued by the Company.
1.3 Client Information
Clients are responsible for providing accurate personal information, including passport details and travel dates. Any costs resulting from incorrect information supplied by the Client shall be borne by the Client.
2. Payments
2.1 Final Payment
The remaining balance must be paid no later than 45 days prior to the tour commencement date unless otherwise agreed in writing.
2.2 Accepted Payment Methods
We accept payments through:
Bank Wire Transfer (SWIFT)
Visa Cards
MasterCard
Pesapal Online Payments
2.3 Transaction Fees
Online credit card payments may be subject to applicable processing fees. Any bank transfer charges imposed by intermediary banks are the responsibility of the Client.
3. Cancellation & Refund Policy
All cancellations must be submitted in writing via email.
3.1 More Than 60 Days Before Arrival
The deposit may be transferred as credit toward a future safari within 12 months or refunded less administrative and transaction fees.
3.2 31β59 Days Before Arrival
50% of the total tour cost is non-refundable.
3.3 30 Days or Less Before Arrival
100% of the total tour cost is non-refundable.
3.4 No-Show
Failure to arrive for a scheduled tour without prior notice will be treated as a cancellation and no refund shall be provided.
4. Changes to Itinerary
4.1 Operational Adjustments
Travel Holidays Tours & Safari Ltd reserves the right to modify accommodations, transportation, routes, or activities when necessary due to weather conditions, road closures, safety concerns, operational requirements, or circumstances beyond our control.
4.2 Accommodation Substitutions
In the event that a booked accommodation becomes unavailable, we will provide an alternative property of similar or higher standard whenever possible.
4.3 Wildlife Sightings
Wildlife movements are unpredictable. While our guides make every effort to maximize viewing opportunities, sightings of specific animals or migration events cannot be guaranteed.
5. Travel Insurance
5.1 Mandatory Insurance
All travelers must obtain comprehensive travel insurance covering:
Medical emergencies
Trip cancellation
Personal accident
Emergency evacuation
Loss of luggage and personal belongings
5.2 Emergency Evacuation
Where applicable, AMREF Flying Doctors emergency evacuation coverage may be included in selected safari packages. This does not replace comprehensive travel insurance.
6. Health & Medical Requirements
6.1 Fitness for Travel
Clients are responsible for ensuring they are medically fit to participate in booked activities.
6.2 Medical Conditions
Any medical conditions, disabilities, dietary restrictions, or severe allergies must be disclosed at the time of booking.
6.3 Vaccinations & Entry Requirements
Clients are responsible for obtaining all required vaccinations, health certificates, and travel documentation necessary for entry into Tanzania.
7. Luggage & Personal Belongings
7.1 Domestic Flight Restrictions
For bush flights and domestic flights within Tanzania, luggage is generally restricted to 15kg (33 lbs) per person in soft-sided bags unless otherwise stated.
7.2 Personal Property
Travel Holidays Tours & Safari Ltd shall not be held responsible for loss, theft, or damage to personal belongings, including cameras, electronics, passports, jewelry, or cash.
8. Force Majeure
Travel Holidays Tours & Safari Ltd shall not be liable for delays, cancellations, alterations, losses, or additional expenses caused by events beyond our reasonable control, including but not limited to:
Natural disasters
Floods
Droughts
Pandemics
Epidemics
Government restrictions
Civil unrest
War
Terrorism
Strikes
Airline disruptions
In such circumstances, we will make reasonable efforts to reschedule services where possible.
9. Photography & Marketing
During tours, photographs and videos may be taken by our staff or representatives for promotional purposes.
By participating in our tours, you grant Travel Holidays Tours & Safari Ltd permission to use such materials for marketing, social media, website content, and promotional campaigns unless you notify us otherwise in writing before the tour begins.
10. Complaints & Claims
10.1 Immediate Notification
Any complaint regarding services provided during the tour must be reported immediately to your guide or our office to allow an opportunity for prompt resolution.
10.2 Post-Tour Claims
Formal complaints submitted after the completion of the tour must be made in writing within 14 days of the tour end date.
11. Safari Vehicles & Mechanical Issues
11.1 Vehicle Standards
Our safari vehicles are regularly maintained and inspected to ensure safety and reliability.
11.2 Mechanical Delays
Despite careful maintenance, mechanical issues may occasionally occur due to challenging road conditions. In such cases, we will make every reasonable effort to repair or replace the vehicle as quickly as possible.
11.3 Liability
No refunds shall be provided for delays caused by unforeseen mechanical issues, although alternative arrangements will be made whenever practical.
12. Client Conduct
12.1 Compliance with Regulations
Clients must comply with all local laws, national park regulations, and instructions provided by guides and tour leaders.
12.2 Respect for Wildlife
Feeding, harassing, or disturbing wildlife is strictly prohibited.
12.3 Right to Refuse Service
The Company reserves the right to terminate a tour without refund if a client’s behavior is illegal, dangerous, abusive, disruptive, or negatively affects the safety and enjoyment of others.
13. Park Fees, Government Charges & Taxes
Tour prices are based on current park fees, concession fees, government taxes, and tourism levies at the time of quotation.
Should any government authority increase such fees or taxes after booking confirmation, the Company reserves the right to pass these additional costs to the Client.
14. Passports, Visas & Travel Documents
14.1 Client Responsibility
Clients are responsible for ensuring they possess valid passports, visas, permits, vaccination certificates, and any other required travel documentation.
14.2 Passport Validity
Passports should generally remain valid for at least six months beyond the intended date of departure from Tanzania.
14.3 Visa Applications
Travel Holidays Tours & Safari Ltd recommends obtaining a Tanzania eVisa before travel where applicable.
14.4 Liability
The Company shall not be responsible for denied entry, deportation, missed flights, or additional expenses resulting from inadequate travel documentation.
15. Governing Law
These Terms and Conditions shall be governed and interpreted in accordance with the laws of the United Republic of Tanzania.
Any disputes arising from these Terms shall be subject to the jurisdiction of the courts of Tanzania.
